Terms of Service
Version 2026-10-10. Please read these terms carefully: section 11 says disputes are settled by individual arbitration, not class actions or jury trials, unless you opt out. These terms are an agreement between you and Laura DeBruin ("we", "us"), who provides FreeClaw Hosted (the "Service"). The Service is run day to day by Elliot DeBruin. By creating an account or using the Service you agree to these terms and to our Privacy Policy. If you don't agree, don't use the Service.
1. Who can use it
The Service is offered only to people in the United States.
You must be at least 13 years old. If you are 13 to 17, a parent or legal guardian must agree to these terms on your behalf. By agreeing, they agree to these terms for themselves too: they are responsible for your use of the Service, for any payment, and for the promises you make in these terms (including section 10). We don't knowingly collect information from anyone under 13; if we learn that we have, we delete the account and its data.
You must give accurate information when you sign up and keep your password private. You're responsible for everything done through your account, including by anyone you share your login or a profile with.
2. What the Service is
FreeClaw Hosted runs an AI agent for you on our server. On your instructions it can search the web, use a browser, read and write files, run scheduled jobs, and work in apps you connect (for example Gmail, Calendar or Slack). It runs on FreeClaw, open-source software under the MIT license.
AI makes mistakes. The agent can misunderstand you, get facts wrong, or take an action you didn't intend. It can also be tricked: web pages, emails and files written by other people can contain hidden instructions (known as prompt injection) that make the agent do something you didn't ask for, such as deleting or changing things in your connected apps or sending your information to someone else. No AI agent can fully prevent this. You choose what the agent can reach and what it may do without asking (Settings → Permissions), and you accept this risk when you connect accounts to it or let it act without asking. Check anything important before you rely on it, especially anything involving money, health, legal matters, deadlines, or messages sent to other people. The agent is instructed not to complete purchases or payments for you; checking out is always yours to do. Settings → Permissions lets you choose whether it must ask before it sends anything or changes anything in your connected apps.
Nothing the Service produces is professional advice (legal, medical, financial or otherwise).
No guarantee of availability. The Service runs on a single server operated by a small team. It may be slow, unavailable, interrupted for maintenance, or stop working without warning, and scheduled jobs may run late or not at all. Data can be lost, including files, conversations, saved logins and settings. Keep your own copy of anything that matters (the Service has a download button for this) and don't rely on the Service for anything time-critical, safety-critical, or where a missed or wrong action would cause you serious harm. Outages don't entitle you to a refund or credit, except where the law requires one.
3. Your responsibilities
You're responsible for what you ask the agent to do and for what it does on your instructions. You decide what to connect, what to sign in to, which permissions to give it (Settings → Permissions), and which jobs to schedule, and you accept the risks of those choices: the agent acts as your tool, and the messages it sends, the changes it makes and the sites it visits for you are your actions. When you connect an account or sign in to a website through the agent's browser, you're using that account under that service's own terms, and you're responsible for following them.
You agree not to use the Service to:
- break any law, or help anyone else break one;
- infringe anyone's copyright, trademark, privacy or other rights;
- harass, threaten, impersonate, defraud or spam anyone;
- create, store or share sexual content involving minors, or any content that exploits or endangers children;
- access accounts, systems or data you aren't authorized to access, or get around a website's security, paywall or rate limits;
- upload malware, or try to probe, overload or break the Service or its security;
- resell the Service or share one paid account between unrelated people as a way around the plan's limits.
We don't review what you store or do (unless you switch on Help improve FreeClaw in Settings), and we have no duty to. But we may look at, remove or block any content, and suspend or close any account, at any time and without notice, if we believe it breaks these terms or the law or puts anyone at risk. We aren't liable for doing so, or for not doing so.
We have zero tolerance for child sexual abuse material. We report apparent child sexual abuse material to the National Center for Missing & Exploited Children (NCMEC) and law enforcement as the law requires, preserve it and the account's information for them, and close the account permanently. We cooperate with law enforcement on other illegal activity too. To report abuse, write to [email protected].
4. Your content and copyright
What you upload, type, and what the agent makes for you ("your content") stays yours. You give us permission to store, process and send your content only as needed to run the Service for you, including sending it to the AI and app providers named in the Privacy Policy.
Only upload, or ask the agent to fetch, copy or publish, material you have the right to use. If you publish a page through the Service, you're responsible for what's on it.
If you believe content on the Service infringes your copyright, send a notice to [email protected] with: your contact details; the work you say is infringed; where the material is on the Service; a statement that you believe in good faith the use isn't authorized; a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for them; and your physical or electronic signature. We respond to valid notices under the Digital Millennium Copyright Act, and we close the accounts of repeat infringers.
5. Plans, billing, renewal and cancellation
Paid plans are subscriptions billed through Stripe. The price, what's included (such as the number of calls a month) and any introductory offer are shown before you pay.
Your subscription renews automatically each month at the plan's price, plus any tax, until you cancel. If you start with an introductory offer, you pay the intro price for the intro period, and then the subscription renews automatically at the full monthly price unless you cancel before the intro period ends. We email you before an intro period turns into the full price.
You can cancel at any time, online, from your dashboard (Unsubscribe). Cancelling stops future charges, and you keep access until the end of the period you've already paid for. Payments are non-refundable except where the law requires otherwise, or where we say so (for example, an intro offer used twice is refunded).
Each plan has a monthly allowance of calls (one call is one step the agent takes) and a fair-use limit on very large usage. When you reach a limit, the agent pauses until the allowance resets at the start of the next month.
We may change prices or plans. We'll tell you by email at least 30 days before a price change affects your subscription, and you can cancel before it does.
Free accounts that aren't used for 60 days may be deleted, after an email warning.
6. Other services
The Service relies on other companies, including OpenAI and TypeSafe (the AI models), Stripe (payments), Cloudflare (network), Linode/Akamai (hosting), Webshare (the browser's internet addresses), Resend (email) and, if you choose to use them, Apple (iPhone app notifications), Composio, Discord and Microsoft. Their own terms and privacy policies apply to what they do. We aren't responsible for their services, outages or changes.
7. Ending your account
You can stop using the Service, cancel, and delete your agents and files at any time; write to [email protected] to have your whole account deleted. We may suspend or end your account if you break these terms, if your use puts the Service or others at risk, or if we stop offering the Service. If we stop offering it, we'll give reasonable notice where we can, refund any prepaid time you lose, and let you download your data first.
8. No warranties
The Service is provided "as is" and "as available", with all faults. To the fullest extent the law allows, we disclaim all warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title and non-infringement, and any warranty that the Service will be available, uninterrupted, timely, error-free or secure, that data will not be lost or corrupted, that the agent's output or actions will be accurate, appropriate or what you intended, or that the Service will meet your needs. You use it at your own risk.
9. Limits on liability
To the fullest extent the law allows, neither we nor anyone who runs, works on or supplies the Service will be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, use, goodwill or other intangible losses, whatever the legal theory and even if we were told they were possible, arising from or related to: the Service or any inability to use it; any outage, delay or loss or corruption of data; anything the agent does, sends, changes or fails to do; content you or others provide; unauthorized access to your account or data that wasn't caused by our gross negligence or willful misconduct; or any third-party service or website.
Our total liability for all claims relating to the Service, together, is limited to the greater of the amount you paid us in the 12 months before the event giving rise to the claim, or $50.
These limits apply even if a remedy fails of its essential purpose. They don't limit liability that the law doesn't allow to be limited, such as for fraud, gross negligence or willful misconduct; some states don't allow some of these limits, so they may not all apply to you.
10. Your responsibility for claims
You agree to defend, indemnify and hold harmless us and anyone who runs, works on or supplies the Service from any claims, losses, damages, fines and costs (including reasonable attorneys' fees) arising from your content, your use of the Service (including anything the agent does on your instructions or with the permissions you gave it), your breach of these terms, or your violation of any law or anyone else's rights. We'll tell you about such a claim and may take over its defense at your expense; you won't settle it without our written consent.
11. Disputes: arbitration and no class actions
Talk to us first. Before starting any claim, write to [email protected] describing it and what you want; we'll try to resolve it within 60 days, and so will you.
Arbitration. If we can't, any dispute between you and us relating to the Service or these terms will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, instead of in court. The Federal Arbitration Act governs this section. The arbitration can be held by video or phone, or in your county. Either of us may instead bring an individual claim in small-claims court if it qualifies, and either of us may go to court to stop infringement or misuse of intellectual property.
No class actions or jury trials. You and we may bring claims against each other only individually, not as a plaintiff or class member in any class, collective, consolidated or representative proceeding, and the arbitrator may not combine claims or award relief for anyone other than the individual party. You and we both give up the right to a jury trial. If this class-action waiver is found unenforceable for a claim, that claim (and only that claim) goes to court, not arbitration.
Opting out. You can opt out of this arbitration agreement by emailing [email protected] within 30 days of first agreeing to these terms, with your username and a statement that you opt out. Opting out doesn't affect the rest of these terms.
Time limit. To the extent the law allows, any claim must be brought within one year after it arose, or it is permanently barred.
Law and courts. These terms are governed by the laws of the State of Pennsylvania and of the United States, without regard to conflict-of-law rules. Anything not arbitrated or in small-claims court will be decided only by the state or federal courts located in Pennsylvania, and you and we consent to their jurisdiction.
12. General
We aren't responsible for delays or failures caused by events beyond our reasonable control, such as outages at our hosting, network or AI providers, power or internet failures, attacks, or natural disasters. If any part of these terms is found unenforceable, the rest stays in effect and that part is enforced as far as it can be. These terms and the Privacy Policy are the whole agreement between you and us about the Service. You can't transfer your account or these terms to someone else; we may transfer them to a new owner of the Service. If we don't enforce a term right away, we can still enforce it later. Sections 3 to 12 survive the end of your account.
13. Changes to these terms
We may update these terms. If a change is material, we'll ask you to agree to the new version before you keep using the Service, and paid subscribers will hear by email first. The version and date are at the top.
